This Privacy Policy (RT2Give
Service) (the Privacy Policy) sets forth certain terms and conditions
pursuant to which Social Media Pay, LLC d/b/a Twitpay (Twitpay, we, or us) may collect, store and use
certain information and data concerning or provided by you or users of your
Twitpay account (collectively, you or your) in connection
with your access or use of the Site (as defined below) or Twitpay's RT2Give donation service (the Service). This
Privacy Policy does not apply to information or data that may be collected by
Twitpay in connection with Twitpay's personal pay service, the privacy policy
for which is located at https://twitpay.me/p/privacy

website and such other web sites established by Twitpay or its subsidiaries
from time to time which specifically reference this Privacy Policy
(collectively, the Site):
This Privacy Policy is
incorporated into and made a part of Twitpay's Terms of Service and Use
Agreement (RT2Give Service)
(Terms of Service).
Capitalized terms used, but not defined, in this Privacy Policy are
defined in the Terms of Service.
Consent
BY USING THE SITE OR THE SERVICE,
YOU SIGNIFY YOUR CONSENT TO THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, PLEASE DO NOT
USE THE SITE OR THE SERVICE. WE
RESERVE THE RIGHT TO MAKE CHANGES IN THIS PRIVACY POLICY AT ANY TIME. PLEASE
CHECK THE PRIVACY POLICY EACH TIME YOU USE THE SITE AND SERVICE TO ENSURE YOU
ARE AWARE OF ANY CHANGES IN OUR PRIVACY PRACTICES. THE PRIVACY POLICY WILL INDICATE THE DATE IT WAS LAST

Privacy
Statement
Twitpay respects the privacy of
its online visitors and users of the Service and recognizes the importance of
protecting the information collected about you. This Privacy Policy applies both to persons who register or
establish an account with Twitpay and to casual browsers of our
Site. This Privacy Policy does not
apply to information that is collected off-line.

Third
Party Web Sites and Services.
This Privacy Policy does not
apply to websites or services maintained or controlled by third parties. If you click on a link to a third party
website, you will leave the Twitpay Site you are visiting and go to the website
you selected. Because we cannot
control the activities of third parties, including third-party payment and
other service providers, we cannot accept responsibility for any use of your
personal information by such third parties, and we cannot guarantee that they
will adhere to the same privacy and security practices as Twitpay. Your Payment Account information will
be stored by our third party payment processors. IF YOU VISIT A THIRD
PARTY WEBSITE THAT IS LINKED TO THE SITE, YOU SHOULD CONSULT THAT WEBSITE'S
PRIVACY POLICY BEFORE PROVIDING ANY PERSONAL OR OTHER INFORMATION.
What is
personal information and when does Twitpay collect it?
Personal information is
information that identifies you and may be used to contact you on-line or
off-line. Twitpay collects
personal information on a voluntary basis. On-line visitors typically submit information to Twitpay
through (1) registration for the Service, (2) customer support or technical
service requests and (3) consumer complaints.
Information collected may include
your name, e-mail address, phone number, mobile number, home address, birth
date, bank account information, credit card information and other personal information as defined under applicable
law. We do not require this
information to gain access to the Site, however, this information must be
provided in order for you to use the Service. We may also require you to provide additional information we
can use to verify your identity or address or manage risk, such as your social
security number and we may also obtain information about you from third parties
such as credit bureaus and identity verification services. You hereby consent to our collection of
your personal information as outlined herein.
Other
Information Collected
When you are using our Service,
we collect information about your donation history and we may collect
information about your computer or other access device for fraud prevention
purposes. We may also mine Twitter
feeds to find tweets and retweets related to RT2Give, or sent through the Service. In addition, we may collect demographic information such as
gender, zip code, information about your computer, hardware, software,
platform, media, Internet IP address and connection and any data that you may
provide in your Twitter profile.
We do not consider personal information to include information that has
been anonymized so that it does not identify a specific user.
A Note
About Twitter Messages
Information you disclose when
retweeting messages or otherwise responding to tweets is public, and there is
no expectation of privacy or confidentiality in Twitter messages or the
metadata contained within such messages.
The content or existence of such messages is not personal information.
A Special
Note About Children
Twitpay
does not permit use of the Service by children under the age of 18. If you are under 18 years of age, you
should not access, or attempt to obtain access to the Service. If we learn that Twitpay has collected
information from a child under the age of 18, we will delete that information
as quickly as reasonably possible.
What
about cookies and other technologies?
We may use cookies and other
technologies to collect demographic information, personalize your experience on
our Site and the Service and monitor other activities. Cookies are small files
downloaded to your computer to track movements and behavior within web sites. Also, we may use cookies to deliver
content specific to your interests and for other purposes. We may link cookie information to
personal information.
Twitpay also maintains log files
which contain Internet Protocol (IPi addresses. An IP address is a numeric address that
is assigned to your computer by your Internet Service Provider. In general, we only use log files to
monitor traffic on our Service, to report aggregate information to charities
and third party service providers and to troubleshoot technical problems. In the event of user abuse of our Site;
however, we may block certain IP addresses. IP addresses may be used to personally identify you in order
to enforce our Terms of Service.
What
happens to the information provided?
Twitpay does not share or
disclose personal information other than as set forth in this Privacy Policy.
The personal information you
provide will allow us to alert you to new features and enhancements and items
of interest. We may send system
emails or tweets (e.g. those regarding forgotten user passwords and updates to
our policies) and we may send e-mails or tweets that contain information
regarding third-party products or services; however, this does not mean that we
have provided or traded your personal information to any party. We may also use your personal
information (1) for purposes of identification; (2) to provide you with ongoing
service; (3) to protect you, and us, against error and fraud or to enforce
legal rights; (4) managing and administering our business and your Account; (5)
meeting legal, regulatory, insurance, security and processing requirements; (6)
for marketing and demographic studies; and (7) otherwise with consent or as
permitted or required by law.
We may disclose your personal information to:
- Organizations
for tax, reporting and other purposes connected with the Service (except
that we do not provide your Payment Account information to Organizations).
- Service
providers who help with parts of our business operations (such as fraud
prevention and payment processing).
- Financial
institutions where your Payment Accounts are held.
- Credit
bureaus, as required or permitted by law.
- Companies
with whom we are considering entering into a merger, acquisition, asset
sale. Law enforcement,
government officials, or other third parties when:
- we
are compelled to do so by a subpoena, court order or similar legal
procedure;
- we
need to do so to comply with law; or
- we
believe in good faith that the disclosure of personal information is
necessary to prevent physical harm or financial loss, to report suspected
illegal activity, or to investigate violations of our Terms of Service.
- Defend
against legal claims.
- Other
third parties with your consent or direction to do so.
We may also share aggregate
consumer data (which does not contain personal information) with third-parties,
and we may use such information for any legitimate business purpose in our sole
discretion.
Where is
the information held?
Currently, Twitpay maintains and
stores your personal information on servers located within the United
States. This may not apply to
Twitpay's third party providers (including, without limitation, our third party
payment processors). In the event
that Twitpay becomes a global organization, some of the computer systems on
which Twitpay collects, stores, and uses the information it collects or
receives may be based outside the United States. Therefore, your personal information may be transferred to,
used, processed or held by Twitpay in the United States and in other countries,
including countries both in and outside the European Union, and used for the
purposes set out in this Privacy Policy.
You hereby consent to such use.
Opt-out
Provision
When we first collect information
about you, we will offer you the opportunity to opt-out of having your personal
information shared with parties outside of Twitpay or its third party providers
(such as Organizations and our payment processors), except to the extent
required by law, court order, or as requested by other government or law enforcement
authority or as otherwise required to process donations. If you choose to have your name removed
from our mailing list, you can do so by contacting our Data Privacy Officer at
privacy@twitpay.com.
Safeguarding
Your Personal Information
We will only collect and use
personal information to the extent deemed reasonably necessary to serve our
legitimate business purposes, and we will use commercially reasonable physical,
managerial and technical safeguards to preserve the security, integrity, accuracy
and privacy of the information you have provided. In addition, we will take reasonable steps to ensure that
third parties to whom we transfer any personal information will provide
commercially reasonable protection of that information. We cannot, however,
ensure or warrant the security of any information you transmit to Twitpay, and
you do so at your own risk. Once we receive your transmission of information,
Twitpay makes commercially reasonable efforts to ensure the security of such
information on our systems. However, please note that this is not a guarantee
that such information may not be accessed, disclosed, altered, or destroyed by
breach of any of our physical, technical, managerial or other safeguards.
Notwithstanding our efforts, the
Internet has inherent security risks including without limitation the risk that
either hackers or individuals with criminal intent can find a way to access
your personal information. Twitpay
cannot promise, and you should not expect, that your personal information
transmitted via the Internet, Internet searches, and other Internet
communications will always remain secure.
If Twitpay learns of a security systems breach, then we may attempt to
notify you electronically so that you can take appropriate protective steps.
Twitpay may post a notice on its Site if a security breach occurs.
Review
and Correction of Your Information; Requests for Removal from Mailing Lists;
and Deactivating Your Account
If for any reason you are
concerned that the personal information maintained by Twitpay is not correct, or if you wish to have your
account(s) deactivated or be removed from our mailing list, please e-mail our Data Privacy Officer at privacy@twitpay.com
describing, in reasonable detail, the nature of the request, problem or
concern. We will then review, update or remove information as appropriate
within a commercially reasonable time frame after receiving such notice from
you. We may still retain your
information in our electronic data or other files, however, to resolve
disputes, enforce our Terms of Service and/or policy(ies), and due to technical
and legal requirements and constraints related to the security, integrity and
operation of the Site or Service.
California
Residents: Your California Privacy Rights
Under California law, California residents who have an established business
relationship with Twitpay may choose to opt out of Twitpay's disclosure of
personal information about them to third parties for direct marketing purposes. As detailed in this Privacy Policy, our
policy is not to disclose personal information collected online to a third
party for direct marketing purposes without your approval. If you choose to opt-out at any time
